End-User License Agreement ("EULA")

This End-User License Agreement (“EULA“) is a legally binding contract between you (“User” or “you“) and Selfotix (“Selfotix“, “we“, “us“, or “our“) for the software product identified as Selfotix, including all related documentation, materials, updates, and user interface designs (collectively, the “Software“).

By installing, copying, or otherwise using the Software, you agree to be bound by this EULA. If you do not agree, do not install, copy, or use the Software.

1. Grant of License

Subject to your compliance with this EULA, Selfotix grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use one copy of the Software on a single device you own or control, solely for personal use, as intended by the Software’s design and functionality.

2. Restrictions and Prohibitions

You shall not, directly or indirectly:

a) Copy, modify, translate, adapt, or create derivative works or improvements of the Software, including its source code, object code, user interface, design elements, or underlying concepts.
b) Rent, lease, lend, sell, sublicense, assign, distribute, publish, or otherwise make the Software available to third parties.
c) Reverse engineer, decompile, disassemble, or attempt to derive the Software’s source code, system design, or proprietary algorithms.
d) Remove, delete, alter, or obscure any copyright, trademark, patent, trade dress, or other proprietary notices.
e) Use the Software for any unlawful, fraudulent, or unauthorized purpose.

3. Intellectual Property and Ownership

The Software is licensed, not sold. Selfotix retains all rights, title, and interest in and to the Software and all associated intellectual property, including but not limited to source code, system architecture, user interface designs, visual assets, trade dress, proprietary algorithms, and research and development results. This EULA does not grant you any ownership rights.

4. Confidentiality

You agree not to disclose, reproduce, or use any confidential information embedded in or accessible through the Software, including proprietary algorithms, system designs, or trade secrets, except as expressly permitted by this EULA. You shall take reasonable measures to protect such information from unauthorized access or disclosure.

5. Third-Party Integrations

You may integrate the Software with third-party platforms, services, or tools (e.g., webhooks or automation services), provided that such integrations do not expose, share, or compromise the Software’s proprietary components, including source code, system design, or user interface. You are responsible for ensuring that any integration complies with this EULA and maintains the security of Selfotix’s intellectual property.

6. Audit and Monitoring

Selfotix reserves the right to monitor usage of the Software and audit your compliance with this EULA, subject to applicable privacy laws, to ensure adherence to its terms and protect proprietary rights.

7. Termination

This EULA remains in effect until terminated. Selfotix may terminate it immediately, without notice, if you breach any of its terms. Upon termination, you must cease using and destroy all copies of the Software. You may not use older versions of the Software after updates are released.

8. Disclaimer of Warranty

The Software is provided “AS IS” without warranties of any kind. To the maximum extent permitted by law, Selfotix disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, Selfotix shall not be liable for any incidental, consequential, indirect, punitive, special, or exemplary damages arising from the use or inability to use the Software, including but not limited to lost profits, data loss, business interruption, or reputational harm.

10. Governing Law and Jurisdiction

This EULA is governed by the laws of India. Any disputes shall be resolved exclusively in the courts of Vijayawada, Andhra Pradesh.

11. Updates and Modifications

Selfotix reserves the right to update the Software and modify this EULA at any time. You are required to install updates to continue using the Software. Continued use after changes constitutes your acceptance of the updated terms.

12. Export Compliance

You agree to comply with all applicable international, national, and local export control laws and regulations governing the use, distribution, or transfer of the Software, including but not limited to the U.S. Export Administration Regulations (EAR), EU export control regulations (e.g., Regulation (EU) 2021/821), and India’s Special Chemicals, Organisms, Materials, Equipment, and Technologies (SCOMET) list. You certify that you are not located in, nor will you use, share, or transfer the Software to, any prohibited jurisdictions, entities, or individuals as designated by applicable export control authorities, including but not limited to U.S., EU, or Indian sanctions lists. You further certify that the Software, including any encryption, artificial intelligence, or data processing functionalities, will not be used for restricted purposes, such as those involving military applications, weapons development, terrorism, or other activities prohibited by law. You are solely responsible for ensuring compliance with these obligations and for obtaining any necessary export licenses or authorizations.

13. Entire Agreement

This EULA constitutes the entire agreement between you and Selfotix regarding the Software, superseding all prior or contemporaneous agreements.
